Timothy Kincaid

Timothy Kincaid has been actively involved in evaluating, negotiating, documenting and reporting financing and securities transactions for over 40 years.  He has been involved in billions of dollars of public and private securities offerings in numerous industries and for Native American tribes.

Mr. Kincaid’s practice has since the late 1980s focused heavily on representation of specialty finance companies providing healthcare receivable-backed financing to healthcare providers and representation of healthcare providers in connection with such financings.  Mr. Kincaid is a pioneer in this field as he worked to develop the first healthcare receivable-backed securities rated by a nationally recognized rating agency.  Since then, he has closed several hundred healthcare receivable financings and handled numerous workouts of troubled healthcare receivable-backed loans.  Mr. Kincaid has also served as an expert witness in two complex cases involving securities matters, one on behalf of an issuer of a surety bond and the other on behalf of a securities underwriter.

Mr. Kincaid’s practice also includes representation of Native American tribal clients in connection with various financings and debt restructuring for economic development activities on reservations.  He has represented over 5% of all Native American tribes in the United States on economic development-related matters.

Prior to founding Kincaid Law in 2003, Mr. Kincaid spent almost twenty-five years building his expertise at major law firms in Nebraska and Washington D.C.  During this period, Mr. Kincaid also headed up E.F. Hutton’s Tax Shelter and Direct Investments Department, which was one of its most profitable departments at the time.  Several years later he founded and operated a healthcare finance firm in New York City which raised debt and equity capital in excess of $70 million and grew to be the second largest healthcare working capital finance company in the United States.

Mr. Kincaid graduated from Case Western Reserve University School of Law in the top 10% of his class and with over four decades in the practice of law and unique knowledge and experience in the discrete areas of healthcare and tribal financings, Mr. Kincaid takes seriously his commitment to “big firm” competency combined with intense attention to client service.  Mr. Kincaid is licensed to practice law in Ohio, New York, Nebraska (currently inactive), and Washington D.C. (currently inactive).
